Terms & Conditions

1. Description of Service

PassTheKeys CH (“PTK”) is an online platform that connects outgoing tenants who need someone to take over their rental contract with incoming tenants searching for housing. PTK does not intervene in property visits, negotiations, evaluations, or contract signing.

PTK is not responsible for:

• Property condition
• Accuracy of listing information
• Decisions made by regies or landlords
• The behaviour or actions of users
• The outcome of applications or lease takeovers

PTK’s role is strictly limited to:

• Providing a secure platform for contact
• Administrative solvency checks
• Handling fee payments via Payrexx tokenisation

2. Solvency Verification

Incoming tenants must provide:

• Last three payslips
• Valid “attestation de non-poursuites”

PTK conducts an administrative solvency check according to the norms required by the landlord/regie. Passing verification does not guarantee approval from the regie or landlord. PTK does not make any decisions regarding who is accepted.

3. Platform Role & Liability

PTK is not a real estate agency, broker, property manager, or legal representative.

PTK assumes no liability for:

• Property condition or defects
• Authenticity or accuracy of information posted by users
• Decisions, delays, or actions taken by regies or landlords
• Rejected applications or failed lease transfers
• Misrepresentations made by users
• Damages, losses, or disputes arising between users

All contractual matters remain strictly between:

1. Outgoing tenant
2. Incoming tenant
3. Regie / landlord

4. Payments, Processing & Fees

All payments are processed exclusively through Payrexx using a tokenisation system. PTK does not store payment data and does not hold funds.

The incoming tenant’s stored payment (tokenised) is charged only when all conditions are met:

1. A visit has been completed
2. Incoming tenant confirms genuine interest
3. The regie selects the incoming tenant

Fee Structure:

• Amount: 50% of one full month’s rent
• Non-refundable
• PTK retains part of the fee
• The remaining part is transferred to the outgoing tenant

5. User Responsibilities

Outgoing Tenants must:

• Provide accurate information regarding the apartment
• Organise, manage, and conduct all visits
• Cooperate with the regie for the lease transfer
• Act honestly and transparently

Incoming Tenants must:

• Provide truthful solvency documents
• Attend scheduled visits
• Independently evaluate the property
• Understand that the regie makes the final selection

6. Privacy & Data Protection

Data is processed according to:

• The Swiss Federal Act on Data Protection (FADP)
• The EU General Data Protection Regulation (GDPR)
• PTK’s internal Privacy Policy

PTK collects only the data required for service delivery, including:

• Identification details
• Solvency documents
• Communication data
• Technical usage data

Payment information is processed only by Payrexx under tokenisation. PTK never stores any card or banking data.

Users retain rights to:

• Access
• Correction* Deletion
• Objection

7. Governing Law

These Terms & Conditions are governed exclusively by Swiss law.
